Datenschutzhinweise für Fotoboxen

1. Verantwortlicher

Verantwortlicher im Sinne der Datenschutz-Grundverordnung (DSGVO) ist:

2. Zweck der Datenverarbeitung

Im Rahmen unserer Eventdienstleistungen (Fotobox, Magic Mirror, Zeichenroboter, KI-Bildsysteme) werden personenbezogene Daten verarbeitet.

 

Zweck der Verarbeitung ist: Erstellung von Fotos, Bereitstellung der Bilder für Gäste, ggf. digitaler Versand per E-Mail, Bereitstellung über QR-Code oder Online-Galerie. Die Nutzung der Fotobox erfolgt freiwillig.

 

3. Art der verarbeiteten Daten

Je nach gebuchter Leistung werden folgende Daten verarbeitet: Fotoaufnahmen (Bilddaten)

ggf. E-Mail-Adresse (bei digitalem Versand) technische Zugriffsdaten (z. B. IP-Adresse beim Download) ggf. Metadaten (Datum, Uhrzeit) Es erfolgt keine biometrische Identifizierung und keine Gesichtserkennung zur Identitätsfeststellung.

 

4. Speicherung und Speicherdauer

Lokale Speicherung: Die Bilder werden zunächst lokal auf dem Gerät gespeichert. Automatische Löschung innerhalb von 7 Tagen oder früher auf ausdrücklichen Wunsch des Auftraggebers

Online-Galerie / Cloud

Sofern eine Online-Galerie oder QR-Code-Bereitstellung gebucht ist: Speicherung in einer geschützten Cloud-Umgebung Löschung nach spätestens 90 Tagen (oder gemäß individueller Vereinbarung)

 

5. Einsatz externer Dienstleister (Auftragsverarbeiter)

Zur technischen Bereitstellung können folgende Dienstleister eingesetzt werden: Hostinganbieter in Deutschland (STRATO )

Mit allen eingesetzten Dienstleistern bestehen – soweit gesetzlich erforderlich – Verträge zur Auftragsverarbeitung gemäß Art. 28 DSGVO.

 

6. Datenübermittlung in Drittländer

Bei Nutzung bestimmter Systeme (z. B. Sketchbot oder KI-Cloudlösungen) kann eine Übermittlung personenbezogener Daten in die USA erfolgen. Die Übermittlung erfolgt ausschließlich unter Einhaltung der Art. 44 ff. DSGVO und auf Grundlage geeigneter Garantien (z. B. EU-Standardvertragsklauseln).

 

7. Rechtsgrundlagen

Die Verarbeitung erfolgt auf Grundlage von: Art. 6 Abs. 1 lit. b DSGVO (Vertragserfüllung mit dem Auftraggeber) Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an der Durchführung des Events ggf. Art. 6 Abs. 1 lit. a DSGVO (freiwillige Einwilligung bei E-Mail-Angabe oder KI-Sonderfunktionen)

 

8. Rechte der betroffenen Personen

Betroffene Personen haben das Recht auf: Auskunft (Art. 15 DSGVO). Berichtigung (Art. 16 DSGVO). Löschung (Art. 17 DSGVO). Einschränkung (Art. 18 DSGVO). Datenübertragbarkeit (Art. 20 DSGVO)

Widerruf einer Einwilligung (Art. 7 Abs. 3 DSGVO)

Beschwerde bei einer Datenschutzaufsichtsbehörde (Art. 77 DSGVO)

Anfragen können jederzeit an die oben genannten Kontaktdaten gerichtet werden.

 

9. Hinweis für Veranstalter

Der jeweilige Veranstalter ist dafür verantwortlich, Gäste über die Anfertigung von Fotos im Rahmen der Veranstaltung zu informieren.

2. Purpose of Data Processing

As part of our event services (photo booth, magic mirror, drawing robot, AI image systems), personal data may be processed.

 

The purpose of the processing is:

 

  • Creating photographs

  • Providing images to guests

  • Optional digital delivery via email

  • Providing images via QR code or online gallery

 

The use of the photo booth is voluntary.

3. Types of Data Processed

Depending on the booked service, the following data may be processed:

 

  • Photographs (image data)

  • Email address (in case of digital delivery)

  • Technical access data (e.g., IP address when downloading images)

  • Metadata (e.g., date and time)

​

No biometric identification and no facial recognition for identity verification are carried out.

​

4. Storage and Retention Period

Local storage:

Images are initially stored locally on the device.

Automatic deletion occurs within 7 days, or earlier upon explicit request of the client.

 

Online gallery / cloud:

If an online gallery or QR code access is booked:

 

  • Images are stored in a protected cloud environment

  • Deletion occurs after a maximum of 90 days (or according to an individual agreement)

5. Use of External Service Providers (Data Processors)

The following service providers may be used for technical operation:

 

  • Hosting provider in Germany (STRATO)

 

Where legally required, data processing agreements pursuant to Art. 28 GDPR have been concluded with all service providers.

6. Data Transfers to Third Countries

When using certain systems (e.g., Sketchbot or AI cloud solutions), personal data may be transferred to the United States.

 

Such transfers are carried out in compliance with Art. 44 et seq. GDPR and based on appropriate safeguards (e.g., EU Standard Contractual Clauses).

7. Legal Bases for Processing

Data processing is carried out on the basis of:

  • Art. 6(1)(b) GDPR – performance of a contract with the client

  • Art. 6(1)(f) GDPR – legitimate interest in conducting the event

  • Art. 6(1)(a) GDPR – voluntary consent (e.g., when providing an email address or using AI-related features)

8. Rights of Data Subjects

Data subjects have the right to:

 

  • Access (Art. 15 GDPR)

  • Rectification (Art. 16 GDPR)

  • Erasure (Art. 17 GDPR)

  • Restriction of processing (Art. 18 GDPR)

  • Data portability (Art. 20 GDPR)

  • Withdrawal of consent (Art. 7(3) GDPR)

  • Lodge a complaint with a data protection supervisory authority (Art. 77 GDPR)

9. Notice for Event Organizers

The respective event organizer is responsible for informing guests that photographs will be taken during the event.
